Remote Monitoring Program

We are proud to offer the connected care program at The Heart Medical Group. The Program is called Circle Health. The goal is to engage people with their health and medical care, to improve the treatment of chronic conditions, and to shift the focus of healthcare from sickness to wellness. 

Using internet connected medical devices we enable people to have the health information that they collect at home such as blood pressure, blood sugar, oxygen levels and heart rate reviewed by their physicians. The physician uses our mobile applications or other forms of communication to provide insight, encouragement, and treatment.

With daily engagement we strive to shift the focus from medicine and treatment to disease prevention and wellness. Using technology, we hope to reinfuse warmth and connectedness into the often-sterile medical relationship between “patient and physician”. We bring the doctor back into the home and thereby hope to create a therapeutic relationship.

End User License Agreement and Privacy Agreement

PARTICIPANT AUTHORIZATION AND TERMS OF USE (Authorization)

NOT FOR EMERGENCY USE; NO REAL-TIME MONITORING: I understand the System is not an emergency response system. If I need emergency care, I will call 911.

I acknowledge and agree that I am participating voluntarily in a remote healthcare management program (the “Program”) offered by my healthcare provider (the “Provider”). The Program has been explained on-line or by a member of the The Heart Medical Group care team and allows me to use a portable Internet-enabled device that interfaces with a remote care management system. I will be monitored daily from 8 a.m. to 5 p.m. I may use the monitor after designated hours and am aware my vital signs will be reviewed the next day. I recognize I will be contacted during normal business hours and I may have to retest based on physician-ordered parameters or if monitored vital signs are incomplete/not received.

NO MEDICAL ADVICE: I acknowledge that the Program is not a substitute for professional medical advice and my reliance upon information obtained through the Program is solely at my own risk. The Heart Medical Group and other third parties shall have no liability for such reliance.

CONSENT TO USE OF MY HEALTH INFORMATION: In connection with my participation in the Program, I hereby agree and consent to the following:

  The Provider,  and other third parties that assist the Provider by providing hardware, software or support components of the System (“System Third Parties”) may use the information I provide in connection with my use of the System (“My Health Information”) to provide the services that are part of the Program.

  Circle Health is a Third Party that operates the software portions of the System for the Provider and support in connection with the System. Circle Health may collect, collate, manipulate, aggregate, analyze and use My Health Information in a manner that separates from, omits, deletes or otherwise excludes from consideration (and from results or reports) information from which my identity can be readily individually determined.

TERMS OF USE FOR THE SYSTEM:

  I understand and agree that I may access the System using only methods and systems identified to me by the Provider as enabled or otherwise approved for access.

  I agree that I will be responsible for any hardware, telecommunications, and computing environments that are not included and are necessary for accessing the System in a manner supported by Provider, Circle Health and the other System Third Parties. I understand and agree that I am responsible for all connection and line charges, including long distance and roaming charges that are not included as a part of the System provided to me by Provider as a part of the Program.

  I agree that I will control my usernames and passwords as private and confidential information, and shall not permit use of my usernames or passwords in connection by any third party except as approved by the Provider in advance in writing. I understand and agree that I am responsible for and shall ensure adequate security over my password and account information, including by securing any computing systems or access devices I use to access the System, and am solely responsible for any misuse or unauthorized use of my account.

RELIABILITY OF COMMUNICATIONS NETWORKS: I understand and agree that neither the Provider nor Circle Health controls the system that provides the internet connectivity for the System or the availability of service for any computer or electronic device. I understand and agree that neither the Provider nor Circle Health  is responsible for any mistake or lack of signal or service because of those systems. I also understand and agree that neither the Provider nor Circle Health  is responsible if one of those systems breaks any laws related to the way information is sent using any computer or other electronic device.

LIMITATION OF LIABILITY: I understand and agree that in no event shall The Heart Medical Group or the other System Third Parties, or any of their respective related parties be liable for any indirect, incidental, special, punitive, or consequential damages (to the fullest extent that such a limitation is permissible under applicable law), including without limitation those resulting from any use of, defect or inaccuracy in, activity of, or loss of use related to the System.

NO OWNERSHIP BY PARTICIPANT: I hereby acknowledge and agree that, other than the limited right to access and use the System as described in this Authorization, I do not possess and will not acquire by virtue of this Authorization any intellectual property or other proprietary rights.

Patient Privacy Policy

Circle Health is the Remote monitoring service offered by The Heart Medical Group. Circle  Health handles and stores data provided by patients to healthcare providers in a secure and safe manner.

The Remote Care Management system is subject to our general Heart Medical Group Patient  privacy policy.

About the Privacy Policy

The purpose of this Privacy Policy is to inform you about what limited information we collect about you and your Health

Circle Health is obligated to protect the confidentiality, integrity, and availability of your personal information which may be in form of Electronic Protected Health Information (ePHI). This obligation is taken very seriously and all measures are taken to keep your personal information protected according to the Health Insurance Portability and Accountability Act of 1996 (HIPAA) privacy and security rules.

Information Handling and Practices

Data Collection

Circle Health collects your health-related information through questionnaires and biometric entries on medical devices. The patient using the Circle health program connected to their healthcare provider, understands that the healthcare organization may collect, store, process, maintain, share, disclose, use, and transmit your health information including, but not limited to the information concerning the assigned device or characteristics of your mobile device along with any peripherals used for the purpose of managing your health biometric, as well as your personal information, location and other content.

Once collected and submitted, your health information is transmitted to a secure server, and it is not stored on the device.

Data Usage

The information is used by your Care Team member to manage your health plan. Only biometric data provided by you are stored in Circle Health’s secured database.

Data Disclosure

Circle Health attempts to minimize the amount of your personal or health information entered via devices based on the Care Team plan or program for you as a patient. Health information entered via devices is disclosed only to your Care Team and application support staff. Circle Health does not share, sell, or license your health information that it may collect via the application.

Reviewing your Information

Patients cannot review health information collected once it is entered in the device, but they can reenter health information manually.

Security of Your Health Information

Circle Health ensures that reasonable administrative, physical and technical security measures are in place to protect your health information from compromise.

Circle Health ensures effective risk analysis, risk management, and regular  activities review, which will include but not limited to access and authorization assessments, privacy and security standards, policies, and enforcement as it affects Circle Health workforce,

Circle Health ensures access to facilities are highly secured and systems used in developing mobile application are physically secured to protect unauthorized physical accesses.

Circle Health uses encryption mechanisms such as Advanced Encryption Standard 256 bits to protect your information while in storage. Circle Health employs the use of Transport Layer Security/Secure Sockets Layer certificates and secured tokens while data is in transit.

You will be reminded to take vital signs through an sms alert on your cellular phone. Through the SMS it may be possible for others who view your phone to infer health care issues.

Your healthcare provider and application support staff may employ additional administrative, physical, and technical security mechanisms to protect your Protected Health Information (PHI) and Personally Identifiable Information (PII).

Individual Rights

It is your right to gain access to your health records or information, and this can be requested through your healthcare provider; however, Circle Health devices do not allow direct access to any reports or health records. Circle Health accommodate requests of access through the providers on whose behalf we are providing the services. It is your right under the HIPAA Privacy Rule to request to access, inspect, or obtain a copy of the collected health information which will be handled by your care provider.

Changes to Privacy Policy Agreement

Circle Health reserves the right to update and/or change the terms of our privacy policy, and as such, we notify healthcare providers who will post such changes in order to keep patients aware of the type of information we collect, how it will be used and under what circumstances, if any, we may disclose such information. If at any point in time Circle Health. decides to make use of any personally identifiable information on file, in a manner vastly different from that which was stated when this information was initially collected, the user or users shall promptly be notified by email. Users at that time shall have the option to permit the use of their information in this separate manner.

Circle Health and its Business partners may notify patients in advance about changes to this Privacy Policy when data practices change due to updates in program or the application.

Acceptance of Terms

Using Circle Health, you are hereby accepting the terms and conditions stipulated within the Privacy Policy Agreement. If you are not in agreement with our terms and conditions, then you should refrain from further use of the Circle Health application. In addition, your continued use Circle Health  following the posting of any updates or changes to our terms and conditions shall mean that you are in agreement and acceptance of such changes.
